Regulatory Agencies are a niche of particular interest at The Navigator Company.   Much of our experience was gained working at making these fascinating organisations effective. 

 

In our experience, these organisations operate under difficult and often conflicting sets of expectations.  They are expected to be tough but flexible, set standards but encourage innovation, be cheap to run but as clever as the regulated,  manage risk but let nothing go wrong, be close to their ’market’, but keep an appropriate distance . . . and so on.

 

“Clods and Monsters” – no win . . .

For the regulatory agency, there are no how-to manuals, no dedicated bookstores, no battery of  big consulting firms, no Sunday TV shows.  With a few notable exceptions, this is a do-it-yourself world.

Alignment is critical

Early learnings . . .

Those expectations are most publicly expressed by politicians, media commentators and taxi drivers (and talk-back radio callers!).  Typically, the regulator is cast either as a bumbling clod – unable to perform the most elementary task or as a power-mad, inflexible monster destroying the lives of honest citizens.  

 

This role as an easy public target for criticism sets up some external and internal dynamics for regulatory agencies that are very tricky to manage. 

True for any organisation and especially critical to the regulatory agency – alignment is the key to  long-term effectiveness.  We offer a model for framing the development of the agency that aims to integrate and align the following elements:

· Regulatory Information Set

· Regulatory Toolbox

· Organisational capability

As a specialised area of learning, regulation is in early stages of development.  This consultancy  does not claim any ‘silver bullet’ solutions.  We have learned from others and particularly acknowledge the work of Professor Malcolm Sparrow of the JFK School of Government at Harvard University and of dozens of colleagues from regulatory agencies in Australia and around the world.
